随着创新能力的增强,越来越多的中国企业“走出去”进军海外市场,在相应的国家寻求专利保护是企业在海外立足的重要举措。笔者今日简单梳理下日本专利申请授权及后续的年费。
对于大多数企业来说,专利申请已不再是陌生的话题。很多企业也开始放眼世界,不在仅限在中国进行专利申请,开始有意识地往海外进行申请-比如我们的近邻日本。笔者认为这是个拓宽思路,挖掘市场潜力的好思维。但,笔者也同时观察到企业大多会忽视专利授权以后的环节,觉得达到证书就大功告成了,对于后续的年金监管关注甚少,导致授权后的专利没过几年就终止了。因此,笔者今日想简单梳理下日本专利申请授权及后续的年费:
一、关于申请类别:
发明:
1、专利权期限从(国际)申请日起20年。
2、自授权通知书下发起30日内需要缴纳授权费即第1到3年年费。
3、从第4年开始缴纳年费,缴费期限对应当年对应授权日的日期。滞纳金期限为:6个月。
实用新型:
1、专利权期限从(国际)申请日起10年。
2、授权费及1-3年年费已在申请时统一缴纳。
3、从第4年开始缴纳年费,缴费期限对应授权日。滞纳金期限为:6个月。
外观设计:
1、专利权期限从授权日起20年(适用于2007年4月1日以后递交的申请)
2、自授权通知书下发起30日内需要缴纳授权费即第1年年度年费。
3、从第2年开始缴纳年费,缴费期限对应授权日。滞纳金期限为:6个月。
二、关于官费标准:年度年费+年度权项费*权项
发明:
实用新型:
外观设计:
比如一件发明申请,拥有10项权要:
那么授权办登官费即为:(2100+200*10)*3年=12300日元。
第4年度年费为:6400+500*10=11400日元,依次类推。
三、关于滞纳期中应缴的年费:6个月内需缴纳相当于两倍的应缴年费金额
If the patent fee for a certain year is not paid within the deadline, a late payment equivalent to double the patent fees can be made if the late payment is paid within six months after the original deadline to pay has expired.
四、中国企业如何缴纳授权后日本发明年费:
《日本专利法》的修正案,于2016年4月1日生效,使非居民专利权人可直接将其每年的专利费从国外汇回。只要你想保持您的专利权,可以在规定的付款截止日前提交付款表格和支付专利年费。
仅限于:授权后的发明专利年费。
注意事项:
1、不适用实用新型专利、外观专利、商标的缴费。
2、不适用已在滞纳期的专利。
3、两种付款方式,表格不要手写,屏幕填写后打印,只可邮寄,不接受邮件及传真。在绝限前寄至JPO.
4、一个案件提交一张付款表格。

Q:1.May I pay patent registration fee directly to the JPO?是否可以直接向JPO缴纳授权费?
A:No, the JPO does NOT accept the direct payment of patent registration fee from oversea residents. The JPO also does NOT accept the direct payment of registration/annual (renewal) fees for utility models, industrial designs, trademark, from oversea residents.
不可以。JPO不接受海外公民直接支付的发明授权费。也不接受海外公民汇入的实用新型,外观设计,商标等年费/续展费。
Q:2.How do I submit the payment form? 如何提交支付表格?
A:You may submit the payment form only by mail to the following address; 通过邮寄方式寄交,地址如下:

Please note that the JPO does not accept the payment form by e-mail nor fax.

Q:3.Can I submit a copy of the payment confirmations in case of paying into a Japanese government account? 支付到日本官方账户时,是否可以提交付款凭证复印件?
A:In principle, you are required to attach the original one.
理论上,要求申请人附上凭证原件。
Q:4.Can I use a credit card or debit card to make a payment?是否可以使用信用卡或者借记卡?
A:No, you cannot use credit card nor debit card to make a payment.
不,两者都不行。
Q:5.I received a notification concerning patent annuity fee payment (e.g., the fee has not paid in full). What should I do?如果我收到年费缴费通知书(比如未缴足费用),我应该如何操作?
A:You may submit the amendment through a representative residing in Japan within 30 days from the date of sending the notification. Where the amendment has not been made within the above time limit, the payment will be dismissed. Please make sure that the amendment should be made by a representative residing in Japan.
你可以自发文日起30天内通过日本代理机构提交修正。如未在上述规定期限内提交,则更正请求将不被受理。请确保更正请求由日本代理机构提出。
Q:6.How can I confirm the procedure completion? 我怎么确认缴费的程序已完成?
A:The JPO send a payment receipt to the payer in about 2 months from submission of the payment form.
收到申请人邮寄的付款表格后,两个月内JPO会给付款人发送已支付年费回执。
Q:7.What should I do in case that the patent fees were paid in excess?如果官费多缴了,我可以怎么操作?
A:You may request the refund of patent fees paid. The request for refund of patent fees should be made by a representative residing in Japan within 1 year from the date of payment.
可以通过日本代理机构在缴费日起1年费提交退款请求。
Q:8.May I cancel the payment? 是否可以撤销付款?
A:No, you may not cancel the payment. 不可以。
Q:9.May I pay annual patent fees for more than two patents in one payment sheet? 付款表格中是否可以填写2件以上案件的年费?
A:No, you may not. You should submit a payment form for each patent right. 不可以,一份表格只可涉及一件授权案件年费。
